These Terms and Conditions (“Terms”) govern access to and use of the inLynk website, platform, applications, features, integrations, and related services (collectively, the “Services”). inLynk is a product operated by InstaVC (“InstaVC,” “we,” “our,” or “us”), a subsidiary of PeopleLink
By accessing, browsing, or using the inLynk website or Services in any manner, you acknowledge that you have read, understood, and agree to be legally bound by these Terms, as well as our Privacy Policy and Cookie Policy, which are incorporated herein by reference.
If you do not agree, you must not access or use the Services.
You represent that you are at least eighteen (18) years of age and have the legal capacity to enter into binding agreements. If you are accessing or using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and all references to “you” shall include the organization.
inLynk is a business software platform that provides tools related to employee engagement, partner relationship management, communication, collaboration, analytics, and related enterprise functions. The Services may evolve over time, and we reserve the right to modify, suspend, discontinue, or replace any part of the Services at any time without liability.
Certain features require account registration. You are responsible for maintaining the confidentiality of login credentials and for all activities occurring under your account. You agree to provide accurate, current, and complete information and to update it as necessary. InstaVC is not responsible for unauthorized access resulting from your failure to safeguard credentials.
Administrators of organizational accounts may have the ability to manage users, access data, and control settings. You acknowledge that your organization may access, monitor, export, or delete data within its workspace in accordance with its internal policies.
You agree not to use the Services in a manner that is unlawful, infringing, abusive, harmful, misleading, or disruptive. You shall not attempt to gain unauthorized access to systems, interfere with platform integrity, introduce malicious code, scrape data, reverse engineer the Services, or use the Services to violate the rights of others or applicable laws.
InstaVC reserves the right to suspend or terminate access where misuse, security risk, or legal exposure is identified.
All intellectual property rights in the Services, including software, designs, logos, trademarks, content, documentation, and underlying technology, are owned by or licensed to InstaVC. Except for the limited right to use the Services as permitted under these Terms, no rights are granted to you.
You retain ownership of content you submit or upload, but you grant InstaVC a worldwide, non-exclusive, royalty-free license to host, process, transmit, and display such content solely for the purpose of providing the Services.
Your use of the Services is subject to our Privacy Policy and Cookie Policy, which describe how personal data is collected, processed, stored, and protected. By using the Services or the website, you consent to such processing in accordance with those policies.
Where inLynk is used by an organization, that organization acts as the data controller, and InstaVC acts as a data processor or service provider. You acknowledge that administrators may access data within organizational accounts.
By accessing the website, submitting contact details, or using the Services, you consent to receive business-related communications, including product updates, service notices, marketing messages, and promotional outreach, to the extent permitted by law. You may opt out of non-essential marketing communications at any time. Service-related communications may continue where legally required.
The Services may integrate with or link to third-party platforms and services. InstaVC does not control and is not responsible for third-party services, content, availability, security, or practices. Your use of third-party services is governed by their respective terms and policies.
Certain Services may be offered on a paid basis. Fees, billing terms, and payment obligations will be specified in applicable order forms, subscriptions, or agreements. Fees are non-refundable except as required by law or expressly stated otherwise.
The Services are provided on an “as available” basis. While we aim for high availability, uninterrupted or error-free operation is not guaranteed. InstaVC may perform maintenance, updates, or changes that may impact availability without liability.
To the maximum extent permitted by law, the Services are provided “as is” and “as available.” InstaVC disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, security, or uninterrupted operation.
To the maximum extent permitted by law, InstaVC, PeopleLink, and their respective directors, officers, employees, affiliates, and partners shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including loss of profits, data, business, goodwill, or revenue, even if advised of the possibility.
In no event shall InstaVC's total aggregate liability arising out of or related to the Services exceed the fees paid by you to InstaVC in the twelve (12) months preceding the event giving rise to the claim, or one hundred U.S. dollars (USD 100), whichever is greater, unless otherwise required by law.
You agree to indemnify, defend, and hold harmless InstaVC, PeopleLink, and their affiliates from and against any claims, damages, losses, liabilities, costs, and expenses arising out of your use of the Services, violation of these Terms, violation of applicable laws, or infringement of third-party rights.
InstaVC may suspend or terminate access to the Services at any time if you violate these Terms, pose a security or legal risk, or if required by law. Upon termination, your right to use the Services ceases immediately. Certain provisions, including intellectual property, disclaimers, limitation of liability, and indemnification, shall survive termination.
InstaVC may disclose information, including account data or usage records, if required by law, regulation, legal process, court order, or governmental request, or where necessary to protect rights, security, public safety, or prevent unlawful activity. Such disclosures may occur without notice where legally permitted.
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Courts located at Hyderabad, India jurisdiction shall have exclusive jurisdiction, unless otherwise required by applicable law.
We may update these Terms from time to time. Updated versions will be posted on the website with a revised “Last Updated” date. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect. Failure to enforce any right shall not constitute a waiver.
